1. Introduction

Welcome to Crypto Lens. These Terms of Service ("Terms") constitute a legally binding agreement between you and Symmetrium Tech ("Company," "we," "us," or "our") governing your access to and use of the Crypto Lens platform, including our websites, applications, APIs, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You may only use the Services if you are at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) and can form a legally binding contract under applicable law. By using the Services, you represent and warrant that you meet these requirements.

You may not use the Services if you are prohibited from doing so under applicable laws or regulations, including but not limited to sanctions and export control laws.

3. Account Registration

To access certain features of the Services, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

• Real-time and historical cryptocurrency price data
• Market analysis and research tools
• News aggregation and sentiment analysis
• Portfolio tracking features
• AI-powered insights and recommendations
• API access for developers (subject to subscription tier)

5. License and Usage Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal or internal business purposes.

You agree not to:

• Copy, modify, distribute, sell, or lease any part of our Services
• Reverse engineer or attempt to extract the source code of our software
• Scrape, crawl, or use automated means to access the Services without authorization
• Use the Services to develop competing products or services
• Resell, redistribute, or commercially exploit our data without express written permission
• Circumvent any access restrictions or security measures
• Use the Services for any illegal or unauthorized purpose
• Interfere with or disrupt the integrity or performance of the Services

7. AI-Generated Content

Our Services may include content generated or enhanced by artificial intelligence technologies. You acknowledge that:

• AI-generated content may not always be accurate, complete, or up-to-date
• AI features, including chatbots and automated analysis, are provided "as is"
• You should independently verify any AI-generated information before acting upon it
• AI outputs should not be considered professional financial or investment advice

8. Subscriptions and Payments

Certain features of the Services require a paid subscription. By subscribing, you agree to:

• Provide accurate and complete billing information
• Authorize us to charge your payment method for all fees due
• Subscriptions automatically renew unless cancelled before the renewal date

Refund Policy: Refunds are evaluated on a case-by-case basis. Monthly subscriptions are generally non-refundable. Annual subscriptions may be eligible for prorated refunds within the first 30 days.

Late Payments: Accounts with payments more than 30 days past due may be suspended or terminated. We reserve the right to assess late fees of 1.5% per month on overdue balances.

9. Third-Party Services and Data

Our Services may incorporate data from third-party providers and may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties. Your use of third-party services is governed by their respective terms of service and privacy policies.

10. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, are the exclusive property of Symmetrium Tech or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

11. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your access to the Services immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Suspected fraudulent, abusive, or illegal activity
• Non-payment of fees
• At our sole discretion for any other reason

Upon termination, your right to use the Services will immediately cease. You remain liable for all charges incurred prior to termination.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding the accuracy, reliability, or completeness of any data or information provided through the Services.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMMETRIUM TECH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Investment losses or trading losses
• Business interruption
• Loss of goodwill or reputation

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Symmetrium Tech and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.

15. Dispute Resolution

Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration, rather than in court. The arbitration shall be conducted in accordance with the rules of JAMS (Judicial Arbitration and Mediation Services).

Class Action Waiver: YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Jury Trial Waiver: YOU AND SYMMETRIUM TECH BOTH WAIVE THE RIGHT TO A JURY TRIAL.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Modified" date. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Symmetrium Tech regarding the Services and supersede all prior agreements and understandings.
